Florida Paternity Law
Florida law treats fathers differently depending on whether their children were born inside or outside of marriage. Under Florida law, children born to married parents are presumed to be the husband's children. However, when children are born out of wedlock and no judgment of paternity is entered, fathers have no legal rights. While a father may still pay child support, the law does not protect his right to parenting time (child custody and visitation).
By filing a motion in a Florida family law court, a biological father can be declared the legal father as well. He will then have a more permanently established relationship with the child, having legal standing to make important decisions in his child's life.
This is a wonderful opportunity for many fathers who are sure of their biological relationship with the child. However, if you have any doubt as to your relationship, it is critical that you talk with a lawyer before a final judgment of paternity is entered in your case. If a final judgment is entered and you later find that you are not the father, you will still be obligated to care for the child. Getting a DNA test is highly recommended.
